This statement (if made by the two people who supposedly worked for the contractor) may be technically correct but it is misleading,

Is this one of those "true but false" thing?

In a court of law, are you required to tell the truth or are you required to not mislead?

Misleading or not is a perception (by others). As long as they provided the facts, they are done. How the facts are to be perceived by others is out of their control and it wouldn't be fair to hold them accountable for things they have no control over.

Isn't that the basis for most all advertising? Sell the sizzle not the steak.

Technically very interesting. But what were they thinking ? They named a product so that the word "AR DUINO" stands out. The kickstarter page has a big title that reads "smARtDUINO Open System by former ARDUINO's manufacturer". They put ARDUINO(tm) right on their boards.
Yet they ridicule Arduino right on their homepage. BTW, "Actual product" and deleted trademark on the UNO board... come on!

Then they cry for being sued... Who's acting childishly here ?

ARDUINO owns just the trademark ARDUINO, not all of its variations. So the smARtDUINO guys have the right to call their product that way.

Factually true.

They put ARDUINO(tm) right on their boards.

That is wrong, definitely. and ARDUINO is within their rights to sue them on that one.

Yet they ridicule Arduino right on their homepage.

Has anyone outlawed ridiculing Arduino?
