I really don't have strong feelings about this specific situation since it doesn't seem like anyone is harmed by this code being shared...
Originally, Atmel used those files to collect contact information (give us your email address then we give you the files). At that time they would have been harmed by not being able to do that.
As far as I can tell, all the parts supported by that code are now obsolete and adesto controls some / most / all of replacements.
For what it's worth, adesto's license is Very Open Source. But I cannot find a replacement for dataflash.*.
