avrdude: problem

I'm getting the following error when Blink is uploaded.

avrdude: stk500_getsync(): not in sync: resp=0x00

Uno with the 328 chip, win7/64 and same issue on win8

The pin 13 LED on the board is on constantly.
Board previously worked.

same here. Did you short it out?

I did see what might have been a short out:.........little sparks when hooking to batteries.

Is it road kill?

replaced the chip on the uno and issue is corrected
