You might check it. Initially it was for RFID use with range limitations but there have been changes. It's in the 70cm Amateur Radio band so it's legal for me. I remember when the FCC proposed the changes the ARRL was against them.
Listen to 433.9 and hear the multitude of digital signals coming from your own devices and all the neighbor devices. There is no way the FCC or any other body stop the use of those devices. Much like the license requirement for CB radio!
the part of Part 15 that says 433 mhz radios are legal actually says they can be left on cargo containers in a port but must be taken off before the container leaves the unloading area of the port. 433 mHz is legal for RFID in Asia

in re you can't stop it: life looks different when you need to have a security clearance to earn a living. breaking an insignificant law is breaking the law. when you have been toiling for 43 years to retire, you get very paranoid in the last few years. it just isn't worth risking running a 43 year marathon and tripping over a puny but deliberate violation of the law when you can see the finish line
We can use Morse code for ID so automating it on a timer is trivial.

Continuous signaling is one of the things I know you can't use 433 for.
I still read everything there is as saying low power low duty cycle non-periodic transmission on 433 is ok.
I have never see any r/c equipment using that frequency.
These days most r/c uses 2.4 GHz for control and telemetry, and 5.8 GHz for video, in the case of flying FPV.
There was use of 27 MHz and 72, I think.

Getting a Technician class license is pretty easy these days which would let you use the band for most modes legally.
