I thought all Arduino core stuff was open source until I spotted this when I uploaded some code.

You might just have seen a copyright notice or two. This means that a part of the core code is copyright.

DERR! - that is not open source is it?
Or maybe you think it is OK to ignore them?

So are you claiming that any software released under the "MIT" license is closed source?:

Copyright (c) [year] [fullname]

Maybe you are claiming the Linux kernel is also closed source?:

Open source is about licensing. The copyright owner grants the world a license to use their intellectual property with freedom. That doesn't change the fact that the creator owns the copyright on that property.
