Question regarding third party boards and direct copies? For YouTube!

First off, wow its been a few years since I logged on here.

Anyway, I'm going to be attempting a second video regarding 'legality' (wrong word, but the best I could thing of, regarding the sale and purchase of non-Genuino or Arduino boards. While unboxing the Uno Wifi 2 and a SparkFun ProtoSnap.

My last attempt, I just went of on the rails.
(please note, after reading the Genuino Brand topic)

The points I'd be trying to make, would be when a person is trying to buy an authentic Arduino and ends up buying a fake, with all the marking while the board tries to look like the real thing, from a site like eBay or what not.

I have two fake/third party Arduino's I own, a Micro (A000053) that is a fake and has all the tags and marking, versus the Arduino leonardo (A0000570) which its self has no tags or markings. I plan to use them both in the new video, showing what's all good and what to avoid, depending on what you 'plan to buy'

In short, buying a few non-Genuino/Arduino boards that are unbranded, DIYed, Sparkfund or another organizations are supported by the community.
While the boards that are marked with all the logos and text, are more frowned upon versus being something you'd get a lawyer knocking on your door, unless you where pretending to be a official reseller...

May I respectfully suggest that you stay away from legal subjects unless you are already an expert. Qualified lawyers will probably find this a complex subject.

Why?

The Arduino design is open source. There is no "fake" Arduinos. There are the gold-standard boards made by Arduino.cc and sold directly or through resellers. Wemos and others make a functionally identical board, but they are "fakes" only to purist snobs.

I have yet to see an Arduino clone that copies the Arduino logo. That would be a fake subject to copyright, but on;y for the use of the logo.

Counterfeit boards making unauthorized use of Arduino's trademarks, and even the "made in Italy" even though they are made in China used to be very common on sites like eBay. My first board was almost certainly a counterfeit, even though I paid the full price on Amazon specifically because I thought the cheap boards I stumbled across on eBay looked sketchy.

I think they might have started getting much more strict about cracking down on that sort of thing in recent years, and perhaps the Chinese manufacturers are gradually realizing that it's possible to make a profit without being a scumbag. Even so, I quickly found one:
