Scam in progress

I share my code and library on mediafire.com since wordpress can't handle zip files or anything with an extension name that is not for entertaining (pics vids).

Several days back I got this message saying one of my code files has been disabled because of intellectual property reasons with the following BS:

The file Phi_1_test_sonic_ranger_v2_nutshell.zip identified by the key (w7g98nf82c7bedh) has been suspended for a reported violation of the DMCA, our Terms of Service, or our Acceptable Use Policy.

The reason for suspension was:

A list of ESA members can be found at http://www.theesa.com/about/members.asp. Under penalty of perjury, we affirm that ESA is authorized to act on behalf of ESA members whose exclusive copyright rights we believe to have been infringed as described herein. ESA is providing this notice to request that you immediately take action with respect to infringements that are occurring at the addresses identified on the attached list. The material located on and/or being distributed from the URLs listed on the attached is infringing the copyright rights of one or more ESA members by copying and distributing unauthorized copies of game products, in violation of applicable copyright laws. The copyrighted works that have been infringed (hereinafter referred to as "Infringing Material") are identified on the attached list by their titles or variations thereof. Because infringement of ESA member copyrighted works by and through your website appears to be significant and widespread, the attached list of titles is a "representative list" identifying a sample of the works infringed. The attached list is not by any means exhaustive of the ESA member works infringed by and through your website. As the law makes clear, a copyright claimant need not identify every infringing work on a site, but rather only a representative list of such works at that site. Having been so informed of the nature and scope of infringement being claimed, the site operator must act to address all infringement on that website, not merely the identified representative examples. Given the infringing activity, the ESA urges you to cooperate with its efforts to protect the intellectual property rights of its members companies and immediately do the following: Immediately take steps to remove or disable access to all of the Infringing Material. Notify any user who may have participated in reproducing or distributing the Infringing Material that their conduct was illegal and could be subject to enforcement. Avoid the same Infringing Material being reposted by the same or other users. Take appropriate action against any responsible user, including termination of repeat offenders. ESA has a good faith belief that the use of the Infringing Material in the manner described herein is not authorized by the copyright owners, their agents, or the law. The information in this notification is accurate. Under penalty of perjury, we hereby affirm that ESA is authorized to act on behalf of ESA members whose exclusive copyright rights we believe to have been infringed as described herein. By providing this notice, neither ESA nor its members are waiving any claims or remedies, or their right to engage in other enforcement activities, and all claims, rights and remedies are expressly reserved. You or the account holders that posted any of the files at the URLs described above may contact ESA at the above-listed contact details, with email preferred. Please include the above-noted Reference Number in the subject line of all email correspondence. Thank you for your cooperation and prompt response in this matter. Sincerely, Intellectual Property Enforcement Entertainment Software Association

This is a post-only mailing. Replies to this message are not monitored or answered.

Then when I clicked on the link, it asks for detailed reasons and my mailing address. I prompted gave them the address to St. My, AS. Is this just one of the scams that wants to collect your name and address to sell or scam with?!

Two things:

Did you check to see if the code had actually been deleted from the website?

Possibly it's someone who is trademark trolling, or whatever it's called... patent trolling I think

It's when someone makes a bunch of patents/trademarks and then goes around suing people all day long, most people just settle, thus free money

That is what I get if I want to download that file. It still shows up on my mediafire main screen though.
I hate attorneys. Who else hates them?

Sounds likes a total douche bag. Got a mention here:

That's what I figured it was... send them a big fat "fuck off"

They'd never win in court, I believe in this case they would have to come to a court you pick...

Nah. I don't have time to arrange court time for those clowns. The legal system of this country is so accurately described as "how much justice you can afford" anyway. I don't have much money so can't afford much justice but on the other hand others can't take too much away from me either LOL

saying one of my code files

Roughly what is it? Something you and you alone wrote? Something based on existing open source?

It is a sonic ranger program running on my phi-1 shield. I wrote every line except for included standard arduino libraries.

I have two suggestions...

  1. Stay away from MediaFire. In my experience they are a magnet for criminals. Use Google Code or GitHub instead (as a bonus you get versioning).

  2. If it is something you want to protect, before releasing it, register it with the Copyright Office. The fee for online registration is $35. Registering it with the Copyright Office is completely independent of how you license it.

I'll try google code. I don't have much experience with google code though. mediafire is pretty much spam but it has a decent upload thingy. I guess it byebye time. The code is only a hundred lines or less. I'd try copyright office for my phi-panel firmware. At over 2,000 lines I hope I'm still only paying $35 at 1.75 cent per line. copy right office or USPTO is pretty much a spam itself. You pay year after year for your patents and they don't protect you. You do it yourself. Lots of these patents are probably lame and don't have enough value to justify the fees, let alone legal fees for preparing for the application. It feels like who's who spam. You pay for feeling good about yourself, most of the times. Only big companies or rare inventions can justify the cost.

Huh. I used to use WordPress. I guess I never tried to upload a zip file. But then, I've always used a host (err, when I was blogging, anyway) where I had ssh access, so I'd just sftp files up in a lot of cases. Now you've got me curious. Have you checked on the WordPress forums? Hard to believe there aren't more people using it who would want to host non-media binary files.

I think I am on the wordpress.com free blog site. There is a wordpress.ORG where things are a little more customizable but I don't know if the site is free or I am able to handle all the options I don't understand. Last time I combed through forum on wordpress.com there was definitely no way to attach zip files.

The Wordpress software, which is available at Wordpress.org, is an open source, very flexible blog platform, that you can download and install on your own server. Wordpress.com, on the other hand, is a free hosting service for the wordpress software, but with its drawbacks.

I like to use Pastebin.com for a few source files, but if you have a real project going, I suggest sourceforge or google code.

I just started using google code and I am feeling my way around the site. Here is one code:

http://code.google.com/p/multi-tap-keypad/

Any suggestions?

Make "multi_tap.pde" "featured" it will be included on the Project Home tab.

Got it. Thanks Coding Badly. For anyone else trying this, just type Featured in a label slot.
