I'd like to stack a prototype shild on an AATmega 2560 and then an ethernet shield on top of that. When I do the ethernet fails because it seems to be using the isp pins. How do I change the ethernet shield to make it work in this configuration

The easiest way is to get a proto shield that extends the ICSP pins through the proto shield. Like this one:
