I saw that the problem is unknown and usually it solves by itself, I have done anything possible (taking the chip off and returning it, replugging the usb cable) but still nothing works. can anyone guide me through this?

Your auto-reset is not working correctly. Hold and release the RESET button right before the Upload occurs.
(BTW, I found that by searching for the error everyone was else was seeing.)
I know there's a Troubleshooting Guide on this web site but I can't find it right now. If I ever do find that thing, I'll try to describe what I know to be missing.
Pulling too much current through the processor or board seems to be a very common mistake: My board shutdown after X seconds. I burned my finger when I touched the board. My servos worked for X seconds and then become erratic. My LED was really bright and then went out.

Yes it seams many get this error because they don't select the correct port in the IDE, but it's not allways the case. I for one still haven't found a solution:
